1. Introduction

These terms govern your use of AI Chat Assistant – Chat Genie and related services operated by Elvee Ltd. By using the app, you agree to these terms and the related privacy policy.

2. Nature of the Service

Chat Genie is an AI-driven conversational assistant that may use multiple third-party AI systems, including ChatGPT, Claude, Grok, and DeepSeek. The official terms state that the app is provided for general informational and entertainment purposes and is not professional advice.

3. Eligibility

You must be at least 12 years old to use the service. If you are under 18, parental or guardian consent is required.

4. Account Registration and Security

Some features require an account. You agree to:

• Provide accurate information
• Keep credentials secure
• Notify Elvee about unauthorized access
• Accept responsibility for misuse caused by your failure to protect credentials

5. Acceptable Use Policy

You must use Chat Genie lawfully and must not:

• Generate or distribute unlawful, harmful, abusive, obscene, or defamatory material
• Upload infringing content
• Reverse engineer, scrape, or automate unauthorized access
• Impersonate others or bypass platform restrictions
• Use the app for harmful or illegal activity

Elvee may suspend or terminate accounts and report unlawful conduct where appropriate.

6. Fair Usage Policy

The official terms reserve the right to monitor usage patterns and enforce temporary or permanent limits where usage is excessive, abnormal, automated, or unfair. Examples listed in the official document include:

• Excessive request volume inconsistent with normal use
• Automated scraping or bulk querying
• Exploiting vulnerabilities or inflating metrics
• Behavior that degrades the service for other users

7. AI-Generated Content Disclaimer

The official terms make clear that:

• AI outputs are automatically generated
• Responses may be inaccurate, incomplete, misleading, or offensive
• Outputs do not represent Elvee's views
• You are responsible for evaluating all AI-generated content
• Chat Genie should not be relied upon for legal, medical, financial, or safety-critical decisions

8. Intellectual Property

All intellectual property in the app, including code, trademarks, design, and documentation, remains with Elvee Ltd or its licensors. When you submit content to the service, you grant Elvee a non-exclusive license to process, store, analyze, and use that content as needed to operate and improve the platform, including use of anonymized data.

9. Subscriptions, Payments, and Refunds

Premium features may be sold through Apple App Store or Google Play. The official terms state that:

• Billing is handled by the relevant platform
• Refunds are governed by that platform's rules
• Elvee does not store payment card details
• Renewal, cancellation, and price information are shown before purchase

10. Data Protection and Privacy

Your use of the service is also governed by the Chat Genie privacy policy. The official terms state that Elvee uses commercially reasonable safeguards but cannot guarantee absolute security.

11. Service Modifications and Availability

Elvee may add, remove, modify, suspend, or limit features for maintenance, legal compliance, or product stability. Downtime, interruption, or data loss may occur, and the official terms disclaim liability for those issues to the extent allowed by law.

12. Termination and Suspension

Elvee may suspend or terminate access immediately for policy violations, legal requirements, or risks to users or platform operations. Users may also close their account by contacting support.

13. Warranties Disclaimer

To the fullest extent permitted by law, the app and all outputs are provided "AS IS" and "AS AVAILABLE" without warranties of accuracy, fitness for purpose, uninterrupted availability, or non-infringement.

14. Limitation of Liability

The official terms say that:

• Elvee and its affiliates are not liable for indirect, incidental, consequential, punitive, or exemplary damages
• Elvee is not responsible for losses caused by reliance on AI-generated content
• Total liability is capped at the amount you paid for the app in the previous 12 months, if any

15. Indemnification

You agree to indemnify and hold Elvee and its affiliates harmless from claims arising from misuse of the app, violation of the terms, infringement, or content you submit.

16. Force Majeure

Elvee is not liable for delays or failures caused by events outside its reasonable control, including natural disasters, cyberattacks, internet failures, war, or regulatory actions.

17. Governing Law and Jurisdiction

The official terms say the agreement is governed by the laws of England and Wales, with disputes subject to the courts of London, United Kingdom, except where mandatory local consumer rights apply.

18. Dispute Resolution

The official terms include an optional arbitration provision under LCIA rules at Elvee's discretion and state that class actions and consolidated claims are waived where permitted.

19. Severability and No Waiver

If any provision is found unenforceable, the remaining terms continue to apply. A failure to enforce any provision does not waive Elvee's rights.

20. Entire Agreement

These terms, together with the privacy policy, form the complete agreement between you and Elvee Ltd regarding the service.
