Terms of Service

This Terms of Service agreement ("Agreement") is a legally binding contract between You, the user of the Elvee mobile application, website, and related services (collectively, the "Service"), and Elvee Ltd, also referred to herein as "Elvee," "We," or "Us." By accessing or using the Service, You acknowledge that You have read, understood, and agree to be bound by this Agreement. If You do not agree to these terms, You must not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, You represent and warrant that You meet this requirement.

2. Account Registration

To access certain features, You may need to create an account. You agree to provide accurate and complete information and to keep this information updated. You are responsible for maintaining the security of Your account and for any activities under Your account. You are also responsible for ensuring the security of Your devices and maintaining confidentiality regarding Your login credentials.

3. License and User Agreement

3.1 License Grant

Subject to these Terms, Elvee Ltd grants You a limited, non-exclusive, non-transferable license, without the right to sublicense, to access and use the Service solely for Your personal, non-commercial use. This license does not transfer ownership of the Service to You. Any breach of these Terms will result in the immediate termination of this license.

3.2 Use Restrictions

You agree to use the Service in compliance with all applicable laws and regulations. You shall not:

Use the Service for any unlawful or prohibited purpose.

Distribute, display, or transmit any material that is unlawful, offensive, defamatory, obscene, abusive, or discriminatory.

Modify, adapt, reverse engineer, decompile, or create derivative works based on the Service.

Use the Service alongside content that promotes hate, violence, or discrimination.

3.3 Intellectual Property Rights

The Service contains proprietary content, including software, text, graphics, and logos, protected by copyright and other intellectual property laws. Elvee Ltd retains all rights, title, and interest in and to the Service and its associated intellectual property. You shall not use the intellectual property, name, logo, or branding of Elvee Ltd without prior written consent.

3.4 Limitation of Responsibility

You agree to indemnify and hold harmless Elvee Ltd, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising from Your use of the Service. Elvee Ltd is not liable for any indirect, incidental, or consequential damages arising from Your use or inability to use the Service. Elvee Ltd's total liability under this Agreement shall be limited to the fees paid by You in the last three months or fifty US dollars, whichever is higher.

3.5 Warranties

The Service is provided on an "as-is" basis without warranties of any kind, whether express or implied. Elvee Ltd disclaims all warranties, including but not limited to merchantability and fitness for a particular purpose.

3.6 Termination

Elvee Ltd reserves the right to terminate Your access to the Service at any time for any reason, including any breach of these Terms. Upon termination, You must cease all use of the Service and destroy any copies of the software or materials associated with the Service.

4. Third Party Services

4.1 Third-Party Reliability

You acknowledge that these features rely on third-party systems and data, and Elvee Ltd is not responsible for any disruptions, inaccuracies, or failures arising from third-party sources.

4.2 No Association Disclaimer

Elvee Ltd is an independent entity and is not owned by, affiliated with, endorsed by, or in any way officially connected with Tesla Inc. Any references to Tesla or other third parties are purely for descriptive purposes.

4.3 Tesla Data Usage

Elvee utilizes data provided by Tesla Inc. for battery diagnostics and analytics of Tesla vehicles. Elvee Ltd is not responsible for the services provided by Tesla Inc., and cannot guarantee the accuracy, reliability, or availability of the data provided by Tesla.

4.4 Regional Availability & User Responsibility

The Service is currently available in regions where Tesla's API is supported. This availability may expand to other regions in the future without prior notice. Users are solely responsible for ensuring that any data, diagnostics, or recommendations obtained through the Service do not interfere with the safe operation and condition of their vehicle.

4.5 User Safety Obligation

Elvee Ltd shall not be held liable for any damage, injury, or loss arising from the User's failure to ensure vehicle safety.

4.6 API and Access Risks

The Service relies on APIs and data provided by third parties, including but not limited to Tesla Inc. Elvee Ltd does not control and is not responsible for the availability, stability, or functionality of these third-party systems.

4.7 Financial Liability Waiver

Users acknowledge that the Service's features may be degraded, interrupted, or discontinued if such third-party providers modify or restrict access to their systems. Users acknowledge that the use of the Service may have financial implications. Elvee Ltd shall not be held liable for any such financial losses or costs incurred through the use of the Service.

5. No Performance Guarantee

Elvee Ltd makes no representation or guarantee that use of the Service will result in accurate battery health estimates, improved battery performance, or any specific outcome. Results, if any, depend on User settings and their use of the Service.

6. Subscriptions and Payments

6.1 Auto-Renewable Subscriptions

Certain features of the Service are offered through auto-renewable subscriptions. By purchasing a subscription, You agree to the following:

Title of subscription: The subscription title and details will be displayed in the App and at the time of purchase.

Length of subscription: Subscriptions are offered on a recurring basis, for example monthly or annual, as displayed at the time of purchase.

Price of subscription: The price of the subscription, including price per unit where applicable, will be clearly displayed at the time of purchase.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.

Cancellation: You may cancel Your subscription at any time through Your Apple App Store account settings. Cancellation takes effect at the end of the current billing period, and no refunds are provided for the unused portion of the period.

Refunds: Subscription fees are non-refundable except as required by applicable law or under Apple's App Store policies.

6.2 Payment Processing

All payments are processed through the Apple App Store and are subject to Apple's terms and conditions.

7. Data Privacy

Your privacy is important to Us. Please review Our Privacy Policy, which details how We collect, use, and safeguard Your personal data. Our Privacy Policy is available at: https://batterydoctor.elvee.app/privacy

8. Disclaimer of Warranty

The Service and associated files are provided "as-is" without any warranties of performance, merchantability, or fitness for a particular purpose. This disclaimer applies to all files created, generated, or edited through the Service.

9. Consent to Data Use

You agree that Elvee Ltd may collect and use information related to Your use of the Service for product support, improvement, and to provide You with notifications or updates.

10. Limitation of Liability

Elvee Ltd takes reasonable security measures to protect Your data; however, You acknowledge that no system is completely secure. Elvee Ltd shall not be held liable for any unauthorized access, data breaches, loss, corruption, or theft of data, nor any damages resulting from such incidents. You agree that Your use of the Service is at Your own risk, and You waive any claims against Elvee Ltd related to data security or breaches.

11. Service Availability

Elvee Ltd does not guarantee uninterrupted access to the Service and is not liable for any unavailability, errors, or interruptions. We reserve the right to modify, suspend, or discontinue any part of the Service without prior notice.

12. Updates and Modifications

Elvee Ltd may, at its sole discretion, modify, update, or discontinue the Service or any part thereof without prior notice. Your continued use of the Service following such changes constitutes Your acceptance of any modifications.

13. Force Majeure

Elvee Ltd shall not be held liable for any failure or delay in performance due to circumstances beyond Our reasonable control, including but not limited to natural disasters, cyber-attacks, government actions, telecommunications failures, or power outages.

14. Assumption of Risk

You acknowledge that the use of battery diagnostics, analytics, and other features within the Service involves inherent risks. You agree that You assume all such risks associated with using the Service, and Elvee Ltd shall not be held liable for any damages resulting from Your configuration or use of these features.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to the Terms

Elvee Ltd may modify these Terms from time to time. You will be notified of any significant changes.
