Please read these Terms of Service ("Terms") carefully before using the AI Study Tutor application operated by Elvee ("Company," "we," "our," or "us").

AI Study Tutor is operated by a company registered in the United Kingdom. These Terms govern your access to and use of the AI Study Tutor mobile application, website, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

AI Study Tutor is intended for students aged 13 to 18 years old:

• If you are under 18, your parent or legal guardian must review and accept these Terms on your behalf
• Parental consent is required before activation of an account for minors
• The Service is not intended for children under 13
• If we discover that a user is under 13, we will suspend the account and delete associated data

2. Account Registration

To access certain features, you must create an account:

• You must provide accurate and truthful information
• You are responsible for keeping your login credentials secure
• You must notify us immediately of any unauthorised use of your account
• You accept responsibility for all activity under your account
• We may suspend or terminate accounts that provide false or misleading information

3. Acceptable Use

You may use the Service only for lawful educational purposes:

• You must comply with UK law and any applicable international laws
• You must not upload or generate illegal, abusive, harmful, extremist, sexual, violent, or self-harm related content
• You must not harass, bully, groom, or exploit other users
• You must not attempt to bypass AI safeguards or security systems
• You must not reverse engineer, interfere with, or disrupt the Service
• You must not commercially exploit any part of the Service

Violation of this section may result in immediate suspension or permanent termination of your account.

4. Child Online Safety & UK Online Safety Act Compliance

We operate in alignment with the UK Online Safety Act 2023 and relevant safeguarding obligations.

4.1 Risk Assessment

We conduct internal risk assessments relating to:

• Exposure of minors to harmful or illegal content
• AI-generated risks
• User-to-user interaction risks (where applicable)

4.2 AI Safeguards

Our AI systems include:

• Automated moderation filters
• Harm detection systems
• Restrictions on illegal or age-inappropriate material
• Escalation procedures for high-risk content

4.3 Harm Prevention

We take proportionate measures to reduce risks of:

• Grooming or exploitation

5. AI Content Disclaimer

AI Study Tutor uses artificial intelligence to generate tutoring responses:

• AI-generated responses may contain inaccuracies or incomplete information
• The Service provides educational assistance only
• We do not guarantee exam results or academic outcomes
• Users are responsible for verifying information before submission
• The Service is not a substitute for teachers, professional tutors, or formal education

6. Subscription and Premium Features

AI Study Tutor may offer premium subscriptions ("Pro Features"):

• Prices are displayed clearly in GBP (£) unless otherwise specified
• Payments may be processed through app stores or authorised payment processors
• Subscriptions may renew automatically unless cancelled
• Refunds are subject to UK consumer protection law and applicable app store policies

7. Fair Usage Policy

To ensure fair access and optimal performance for all users, AI Study Tutor operates under a Fair Usage Policy:

• The Service is intended for reasonable personal educational use
• Excessive automated requests, bot usage, or scripted interactions are prohibited
• Use of the Service in a way that places disproportionate load on our systems may result in temporary limitations
• We may impose usage caps on AI interactions, practice questions, or premium features where necessary
• Attempts to circumvent usage limits, subscription tiers, or technical restrictions are strictly prohibited

If we determine that usage is excessive, abusive, or intended to exploit system resources, we may:

• Temporarily restrict access
• Limit certain features
• Suspend or terminate the account

8. Intellectual Property

• AI Study Tutor, including its AI systems, design, trademarks, logos, software, and materials, is owned by Elvee or its licensors under UK intellectual property law
• You may use the Service for personal educational purposes only
• You may not copy, reproduce, distribute, reverse engineer, or commercially exploit any part of the Service without written consent
• User-submitted content remains the property of the user, but you grant us a non-exclusive licence to use it to operate and improve the Service

9. Suspension & Termination

We may suspend or terminate accounts:

• For breach of these Terms
• For safety or safeguarding reasons
• To comply with UK law
• To protect users

Termination does not remove prior obligations or liabilities.

10. Limitation of Liability

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under UK law

To the extent permitted by law:

• We are not liable for indirect or consequential losses
• We are not liable for academic performance outcomes
• The Service is provided “as is” and “as available”

11. Changes to These Terms

We may update these Terms periodically.

Where required, we will notify users via email or in-app notice.

Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws provide otherwise.
